Rules of the ‘Cashback with Visa QR’ promotion

1. General

1.1. These Rules of the ‘Cashback with Visa QR’ promotion (the Rules) establish the procedure for running the promotion (Promotion), including participation conditions and bonus award and payment to the Promotion participants.

1.2. Purpose of the Promotion: The Promotion is held by Kcell JSC (Operator) in order to promote payments for public transport services and retail outlets using cell phone balance via Visa QR/QRpay, create an influx of new users of the mobile financial services, as well as stimulate the Operator's customers to use more mobile financial services.

1.3. Promotion terms and conditions:

1.3.1. Promotion duration: 22 October 2020 through to August 31, 2021.

1.3.2. Territory – Kazakhstan (within Operator’s network coverage area)

1.3.3. Participants of the Promotion are the activ and Kcell customers (Subscriber) who are the citizens of the Republic of Kazakhstan, or foreign citizens who have a residence permit in the Republic of Kazakhstan and who own their mobile numbers as individuals.

2. Promotion terms and conditions

2.1. To be eligible for the Promotion, the activ customers must meet all of the following criteria:

2.1.1. Participant makes payments (Payment) with the cell phone balance (airtime) in the cities of the Republic of Kazakhstan for:

- public transport services (use the My activ/Kcell app to scan a Visa QR code that can be found inside the vehicle);

- goods/services (use the My activ/Kcell app to scan a Visa QR code that can be found inside the sales point premises) and get confirmations of successful Payments.

2.1.2. This payment method is available in all cities of Kazakhstan:

- on all city buses equipped with the electronic ticketing system and have a sticker with a Visa QR code inside the vehicle;

- in all outlets that accept non-cash payments via Visa QR/QRpay and/or have a sticker with a Visa QR code.

2.1.3. To pay for public transport services, scan the Visa QR code on a sticker inside the passenger compartment of the vehicle using the My activ/Kcell application (except for suburban routes).

After that, the subscriber gets an SMS containing an electronic ticket. The fare cost is deducted from the subscribers�s cell phone balance..

The fare varies by city. The ticket is valid for one trip only. To purchase a new ticket, the Participant must scan the Visa QR code again and get an SMS with an e-ticket.

The cities of the Republic of Kazakhstan where you can pay by Visa QR/QRpay in public transport: Nur-Sultan, Almaty, Taldykorgan, Kyzylorda, Aktobe, Petropavlovsk, Aktau, Atyrau, Kostanay and Turkestan. More information on bus routes that accept Payments can be found here https://smsbus.kz.

2.1.4. To pay for goods/services at a sales point, use the My activ/Kcell application to scan the Visa QR code on a sticker that can be found inside the sales point. When everything is done correctly, Participant will receive an SMS confirming the payment. The cost of goods/service will be deducted from his/her cell phone balance.

2.1.5. At the time of Payment, Participant must make sure he/she has sufficient balance to cover the cost of the service. Payments by Visa QR/QRpay codes are fee-free. This payment is available to prepaid retail customers. The citizens enjoying the right of free use of the public transport do not participate in the Promotion.

2.1.6. The Participant’s mobile number must be in ‘active’ status.

2.1.7. Once the Payment has been accepted, the Participant will have cashback credited to his/her mobile balance:

- up to 30% of the public transport fare.

- up to 15% of the payment for goods/services at the sales points, using the My activ/Kcell app to scan the Visa QR code on a sticker inside the sales points.

2.1.8. Conditions for receiving a cashback:

- cashback is provided only for 2 trips per day per mobile number from which the Payment was made. Cashback is not credited for the 3rd and subsequent trips on that day.

- cashback is provided for not more than 2 (Two) Visa QR/QRpay payments per day per mobile number from which the Payment was made for goods/services at the sales points, using the My activ/Kcell application to scan the Visa QR code on a sticker inside the sales point.

- the maximum amount of cashback per one completed Payment is no more than 500 (five hundred) tenge.

- the maximum amount of cashback per month per one mobile number is no more than 5000 (five thousand) tenge.

2.1.9. Cashback is credited to the customer’s mobile balance at the expense of the Operator.

2.1.10. Cashback is credited instantly. In exceptional cases (technical and/or other reasons) Operator has the right to set a different period for crediting cashback, which should not exceed 5 (five) business days from the date of the Payment.

2.1.11. In case the Payment is returned for any reason, the respective cashback will be instantly automatically debited from the Participant’s mobile balance. In exceptional cases (technical and/or other reasons) Operator has the right to set a different period for cashback debiting, which should not exceed 5 (five) business days from the date of the Payment return.

2.2 Subscribers referred to in par. 2.1 hereof who made payment prior to the Promotion commencement will not be included in the list of Participants.

2.3 This Promotion applies only to Visa QR/QRpay payments, all other QR payments do not participate in the Promotion.

2.4 Cashback is not credited for payments made with Visa QR/QRpay to top up activ/Kcell mobile numbers or e-wallets via various pay points, websites or mobile applications.

2.5 During the Promotion period, Operator has the right to send SMS messages to its subscribers with information about the Promotion.

2.6 Cashback credited to the Participant’s cell phone account can be used to make subsequent payments for services/goods and payments using the subscriber's balance, except for payment of debt for "Extra Balance", "Auto Extra Balance", "Extra Megabytes", "Auto Extra Megabytes" services.

2.7 By performing the actions specified in these Rules, Participants confirm that they have read and agree to be bound by the Terms and Conditions of the Promotion.

2.8 Operator has the right to refuse to provide a cashback in case the Participant fails to fulfill the conditions provided for herein or fails to meet the requirements specified herein, or on the basis of clause 4.2.3 of Appendix 2 to the Public Agreement in case the participant is found to have committed/attempted/be involved in fraudulent actions and/or suspicious transactions.

2.9 The prize pool of the Promotion is formed at the expense of the Operator.

3. Final provisions

3.1. All information about the Promotion can be found on qr.activ.kz

3.2. Operator reserves the right to review the terms of this Promotion by posting relevant information on activ.kz, kcell.kz or qr.activ.kz. Changes will take effect on the date of publication.

3.3. Operator is not responsible for:

3.3.1. Untimely fulfillment / non-fulfillment by the Participants of the Promotion conditions provided for in these Rules;

3.3.2. A failure to receive cashback by the Participants for any reason due to the fault of the Participant.

4. Additional conditions:

4.1. Operator has the right to change unilaterally these Rules for any reason that does not contradict the laws of the Republic of Kazakhstan, subject to giving notice to the Participants on the day of their change by posting the amended Rules, including additional

information regarding this Promotion, on qr.activ.kz website.

4.2. Operator bears no responsibility in connection with any disputes regarding ownership, possession or use of subscriber devices and subscriber numbers, as well as their registration. Any person who claims to be the owner of the mobile number that was used to

participate in the Promotion will be considered its current owner (mobile number is registered with his/her IIN), provided that other supporting documents have been furnished to the Operator and/or the Operator's regional subdivision.

4.3. In case the Participant claims a cashback in accordance with these Rules, Operator will provide a response in accordance with the requirements of the Public Agreement and the current legislation of the Republic of Kazakhstan.

4.4. Operator is not responsible for technical and technological errors that may occur in cellular networks or equipment of the Operator.

4.5. All disputes related to the Promotion should be resolved through negotiations. Failing which, such dispute should be considered in the relevant court of the Republic of Kazakhstan in accordance with the current legislation.

4.6. In case of third parties’ claims brought against the Operator in connection with the Participant’s violation of third parties rights during the Promotion, Participant takes responsibility for independent resolution of such disputes at own expense.

4.7. These Rules of the Promotion will be published by the Operator on qr.activ.kz website.

5. BY PARTICIPATING IN THE PROMOTION, YOU AGREE TO BE BOUND BY THESE RULES.
